Waiter files charges vs Jude Bacalso

CEBU CITY — Cebu-based personality Jude Bacalso is facing multiple raps following a viral incident where she allegedly forced a waiter to stand for nearly two hours after the latter addressed her as "sir."

On Wednesday, the Cebu City Prosecutor's Office formally received complaints of unjust vexation, grave scandal, grave coercion, grave threats and slight illegal detention against Bacalso.

The 24-year-old waiter, who has chosen to remain anonymous, filed the cases with the help of his lawyer Ron Ivan Gingoyon.

The incident, which took place on July 21 at a restaurant in a Cebu City mall, reportedly began when Bacalso reprimanded the waiter and made him stand in a "parade rest" position for approximately one hour and 49 minutes after he allegedly "misgendered" her.

John Calderon, a netizen who witnessed the event, shared the details on social media, describing the waiter's visible distress during the ordeal.

Bacalso, a prominent figure in Cebu's LGBTQ community, later addressed the incident on social media, expressing her frustration over the incident.

She acknowledged that the waiter had stood before her but claimed it was not at her insistence.

Bacalso explained that they were both waiting for the restaurant's management to address the issue, noting her close relationship with the owners, one of whom is a transwoman.

Following backlash on social media, Bacalso issued an apology, admitting that her reaction could have been more compassionate.

"I also realized that in the impassioned pursuit of my advocacy, I could have done with a little measure of kindness, sadly quite absent in the ruckus this has all unnecessarily created when it was made public without our knowledge," portion of her statement reads.

She also met with the restaurant's management and staff members to discuss promoting more inclusive practices, although the waiter involved was not present.

Despite Bacalso's apology and efforts to resolve the matter privately, the waiter decided to pursue legal action nearly a month after the incident. His lawyer cited the various charges as a response to the mental and emotional distress his client endured.

Bacalso, known for her career as a writer, television personality and events host, has yet to publicly comment on the charges filed against her. The case continues to garner attention both locally and online as it progresses through the legal system.
