Lawyer to face charges over ownership dispute

A LAWYER is facing charges after allegedly trying to take control of a resort in Balabag on Boracay Island in Malay, Aklan.

Marichi Ramos, who claims to be the proprietor of The Cliff Resort, said that lawyer Lucas Licerio had rented out her property based on a false ownership claim.

Ramos also alleged that Licerio filed a complaint before the Police Regional Office-6 (PRO-6) to eject the resort's security agency and take over the property.

She requested PRO-6 commander BGen. Jack Wanky for a copy of the complaint filed by Licerio against the Safety Protection Yielders Security Agency.

In her letter to Wanky, Ramos claimed Licerio had been illegally occupying, selling and leasing the villas at The Cliff Resort, which he did not construct or own.

Ramos said in her letter that Licerio's recent complaint was baseless and should not be entertained unless he would provide proof of compliance with a Sosia order issued in 2017 arising from a complaint she filed against Licerio.

This request is to ensure a proper and informed response to the allegedly misleading claims made by Licerio in his complaint. The complaint pertains to the security agency engaged by Ramos to safeguard The Cliff Resort.

Ramos intends to prepare a formal opposition, highlighting previous misrepresentations by Licerio and records of a prior complaint she filed against two other security agencies, Kislap Security Agency and JVG Security Agency.

These agencies were previously employed by Licerio and were involved in an alleged forcible takeover of The Cliff Resort on July 1, 2016.

Ramos and the Safety Protection Yielders Security Agency had requested to be served a copy of Licerio's formal complaint in the form of a verified complaint before responding to his allegations.

Licerio, who also claimed ownership of the property, had asked the PNP to revoke the permit of Safety Protection Yielders over its role in the alleged illegal takeover of a property in Boracay.

He alleged that the security agency had assumed jurisdiction over the Licerio Estates since April 24 and reportedly denied entry to individuals who have private villas inside the Licerio Estates.

It can be recalled that Licerio, who represented his family as co-heirs, initially sold 700 square meters of the more than 1-hectare property to Dolora Khanna in May 2007.

Khanna later filed an injunction plea against Licerio to vacate the entire property.

The injunction plea that was eventually denied by the court in Kalibo led to the discovery that Khanna falsified documents that made it appear that she owned the entire Licerio Estates. She also sold portions of the land that she did not own.

Khanna would later be convicted of estafa through falsification of public documents by a court in Kalibo and has reportedly fled the country.

Licerio said that before Khanna left the country, she had authorized Ramos to represent her in business and financial matters.
